TERMS OF SERVICE

These Referral Program Rules & Terms and Conditions ("Terms") govern participation in the MCAT Simplified Referral Program (the "Referral Program"). By participating in the Referral Program, you agree to these Terms. 

  1. Program Overview 

The MCAT Simplified Referral Program allows eligible former students to refer new customers to MCAT Simplified. 

For each qualifying referral: 

  • The referred customer ("Referred Customer") may receive 50 off their first qualifying purchase of a course from MCAT Simplified. 
  • The eligible referring student ("Referrer") may receive a 50 cash referral reward after the referral satisfies all qualification requirements described in these Terms. 

There is currently no limit on the number of qualifying referrals an eligible Referrer may make. 

MCAT Simplified reserves the right to modify, suspend, or terminate the Referral Program at any time, subject to applicable law. 

  1. Eligibility to Participate as a Referrer 

To participate as a Referrer, an individual must: 

  1. Have previously purchased a course or other qualifying educational offering directly from MCAT Simplified; 
  2. Have a valid MCAT Simplified account, where applicable; 
  3. Receive or have access to a unique referral code issued by MCAT Simplified; and 4. Comply with these Terms and all applicable laws and regulations.

Employees, contractors, affiliates, business partners, or other individuals designated by MCAT Simplified may be excluded from the Referral Program unless expressly authorized by MCAT Simplified. 

MCAT Simplified reserves the right to determine eligibility and to suspend or terminate participation if it reasonably believes a participant has violated these Terms or abused the Referral Program. 

  1. Definition of a New Customer 

For purposes of this Referral Program, a "New Customer" or "Referred Customer" means an individual who: 

  1. Has never previously made a purchase from MCAT Simplified; and 
  2. Makes a qualifying purchase using a valid referral code belonging to an eligible Referrer. 

A person who has previously purchased any course, program, product, service, or other paid offering from MCAT Simplified is not considered a New Customer, even if that person has not purchased recently or has never previously used a referral code. 

Creating a new account, using a different email address, or otherwise attempting to appear to be a new customer does not make an existing customer eligible. 

MCAT Simplified will determine whether a customer qualifies as a New Customer based on its records and other information reasonably available to it. 

  1. Referral Codes 

Each eligible Referrer may receive a unique referral code issued by MCAT Simplified. 

The referral code may be shared with friends, family members, colleagues, or other individuals who may be interested in purchasing a course from MCAT Simplified. 

The referral code: 

  • Is assigned to the specific Referrer; 
  • May not be sold, transferred, or assigned to another person; 
  • May not be used by the Referrer to make a purchase for themselves;
  • May not be used to create fraudulent or fictitious transactions; and 
  • May be deactivated or replaced by MCAT Simplified at any time.

MCAT Simplified may limit or reject referral codes that are distributed in ways that violate these Terms or applicable law. 

  1. Referred Customer Discount 

A Referred Customer who uses a valid referral code may receive 50 off their first qualifying purchase. 

The minimum qualifying purchase amount is 500 before application of the 50 referral discount, unless MCAT Simplified expressly states otherwise. 

Because MCAT Simplified currently does not offer courses below 797, the 50 referral discount will generally apply to qualifying course purchases at or above that amount. 

The referral discount: 

  • Is available only to eligible New Customers; 
  • Applies only to the customer's first qualifying purchase; 
  • May not be exchanged for cash; 
  • May not be transferred; 
  • May not be redeemed for a cash equivalent; 
  • May not be used by an existing customer; 
  • May not be used for self-referrals; and 
  • May not be combined with other promotional offers or discount codes unless expressly permitted by MCAT Simplified. 

MCAT Simplified reserves the right to determine whether a purchase qualifies for the referral discount. 

  1. Referrer Cash Reward 

An eligible Referrer will receive a 50 cash reward for each qualifying referral. 

A referral becomes eligible for the cash reward only when all of the following conditions have been satisfied: 

  1. The Referred Customer is a New Customer; 
  2. The Referred Customer uses the Referrer's valid referral code; 
  3. The Referred Customer completes a qualifying purchase of at least 500 before application of the referral discount; 
  4. The purchase is successfully completed and payment is received by MCAT Simplified;
  5. The Referred Customer remains a confirmed student; 
  6. At least seven (7) days have passed following the qualifying purchase; and 7. The transaction has not been canceled, refunded, charged back, or otherwise determined by MCAT Simplified to be invalid or ineligible. 

Until all qualification requirements have been satisfied, the referral reward may be designated as Pending

  1. Timing of Referral Payments 

Once a referral satisfies all qualification requirements, MCAT Simplified will make reasonable efforts to issue the 50 cash reward in accordance with its standard referral payment process. 

The seven (7) day qualification period is intended to allow MCAT Simplified to verify the transaction and confirm that the enrollment remains valid. 

If a purchase is canceled, refunded, charged back, or otherwise invalidated before the referral reward is paid, the Referrer will not be entitled to the $50 reward for that referral. 

If a refund, chargeback, cancellation, or other disqualifying event occurs after a referral reward has already been paid, MCAT Simplified may, to the extent permitted by applicable law, reverse or recover the reward or offset the amount against future referral rewards. 

  1. Unlimited Referrals 

There is currently no maximum number of qualifying referrals that an eligible Referrer may make. 

For example, if a Referrer generates: 

  • 1 qualifying referral, the Referrer may earn 50; 
  • 5 qualifying referrals, the Referrer may earn 250; 
  • 10 qualifying referrals, the Referrer may earn 500; and 
  • 100 qualifying referrals, the Referrer may earn 5,000. 

All referrals must be genuine and must satisfy these Terms. 

MCAT Simplified reserves the right to investigate unusually high-volume referral activity and to delay payment while conducting a reasonable review.

  1. Prohibited Referral Activity 

Participants may not: 

  1. Refer themselves; 
  2. Create or use multiple accounts to obtain referral discounts or rewards; 3. Use another person's identity or information to generate a referral reward; 4. Refer an individual who is already an existing customer; 
  3. Make a purchase for the purpose of creating a fraudulent referral; 
  4. Submit false, misleading, or fraudulent information; 
  5. Manipulate, interfere with, or attempt to circumvent the Referral Program's tracking or qualification system; 
  6. Use automated systems, bots, scripts, or other methods to generate fraudulent referrals; 9. Sell, purchase, or trade referral codes; 
  7. Misrepresent MCAT Simplified, its courses, programs, pricing, outcomes, or services; 11. Make false, deceptive, or misleading statements about MCAT Simplified in connection with a referral; 
  8. Represent that they are an employee, representative, or authorized agent of MCAT Simplified unless they actually are; 
  9. Use paid advertising or search advertising containing MCAT Simplified's trademarks or brand terms for referral purposes without written authorization; 
  10. Spam individuals with referral communications; or 
  11. Engage in any activity that MCAT Simplified reasonably determines is fraudulent, abusive, deceptive, or inconsistent with the purpose of the Referral Program. 
  12. Referral Communications and Disclosures 

Referrers may share their referral code with individuals who may genuinely be interested in MCAT Simplified's courses. 

When promoting MCAT Simplified or its courses publicly, including through social media, websites, online communities, or other public channels, Referrers must be truthful and must not make false, misleading, or unsubstantiated claims. 

Because Referrers may receive a 50 cash reward when their referral results in a qualifying purchase, Referrers should clearly disclose this financial relationship when making promotional statements or endorsements where such disclosure is required. 

An example of an appropriate disclosure is: 

"I may receive 50 if you enroll using my referral code."

Referrers should not claim or imply that they are independent representatives of MCAT Simplified or that they are authorized to speak on behalf of MCAT Simplified. 

MCAT Simplified may request that a Referrer remove or correct promotional content that violates these Terms or applicable law. 

  1. No Guarantee of Referral Rewards 

A referral code being used does not automatically guarantee a 50 reward. The referral must satisfy all eligibility and qualification requirements in these Terms. MCAT Simplified's records will generally determine whether a referral qualifies for a reward. 

  1. Referral Attribution 

A referral will generally be attributed to the Referrer whose valid referral code is successfully used by the New Customer during the applicable enrollment or checkout process. 

A customer may not use multiple referral codes, if attempted, MCAT Simplified may apply its referral attribution rules to determine which Referrer, if any, receives credit. 

MCAT Simplified is not responsible for referral rewards that cannot be properly attributed because a customer fails to enter a valid referral code or provides inaccurate information. 

  1. Refunds, Cancellations, and Chargebacks 

If a Referred Customer's qualifying purchase is canceled, refunded, reversed, charged back, or otherwise invalidated before the Referrer has received the reward, the referral will not qualify for the 50 cash reward. 

If a reward has already been paid and the underlying transaction is subsequently refunded, canceled, reversed, or charged back, MCAT Simplified may, to the extent permitted by law, recover the reward or deduct the amount from future rewards.

  1. No Self-Referrals 

A Referrer may not use their own referral code to obtain a discount or referral reward. 

A Referrer also may not arrange for another person to make a purchase on their behalf for the purpose of obtaining a referral discount or reward. 

MCAT Simplified may reject any transaction that it reasonably believes constitutes a self-referral or an attempt to circumvent this rule. 

  1. Family, Friends, and Household Members 

Eligible Referrers may refer genuine New Customers, including friends, family members, colleagues, or members of the same household, provided that the Referred Customer has never previously made a purchase from MCAT Simplified and the transaction is genuine. 

Sharing a household, address, device, or internet connection does not by itself disqualify a referral. 

However, MCAT Simplified may investigate referrals that present other reasonable indicators of fraud or abuse. 

  1. Taxes and Payment Information 

Referral rewards are promotional compensation and may have tax consequences for the recipient. 

Referrers are responsible for providing accurate payment and tax information requested by MCAT Simplified or its payment provider and for complying with their own tax obligations. 

MCAT Simplified may be required to collect tax information and/or report referral payments to governmental authorities as required by applicable law. 

  1. Program Abuse and Investigation 

MCAT Simplified reserves the right to investigate any referral activity that it reasonably believes may violate these Terms or involve fraud, abuse, manipulation, or other improper conduct.

During an investigation, MCAT Simplified may temporarily place referral rewards on hold. If MCAT Simplified determines that a participant has violated these Terms, it may: 

  • Reject pending referrals; 
  • Withhold unpaid rewards; 
  • Reverse previously issued rewards to the extent permitted by law; 
  • Disable or deactivate a referral code; 
  • Suspend or terminate participation in the Referral Program; and/or 
  • Take any other action reasonably necessary to protect the integrity of the Referral Program. 
  1. No Employment, Agency, or Partnership 

Participation in the Referral Program does not create an employment relationship, agency relationship, partnership, joint venture, franchise, or other formal business relationship between the Referrer and MCAT Simplified. 

Referrers are not authorized to make commitments, representations, warranties, guarantees, or promises on behalf of MCAT Simplified. 

  1. Changes to the Referral Program 

MCAT Simplified may modify the Referral Program, including: 

  • Reward amounts; 
  • Discount amounts; 
  • Eligibility requirements; 
  • Qualification requirements; 
  • Payment procedures; 
  • Referral limits; 
  • Program terms; and 
  • Other program rules. 

MCAT Simplified reserves the right to make any changes without notification. 

Unless otherwise required by applicable law, changes will not affect referrals that have already fully qualified for payment before the effective date of the change.

  1. Suspension or Termination 

MCAT Simplified may suspend or terminate the Referral Program at any time. 

MCAT Simplified may also terminate or suspend an individual participant's access to the Referral Program if the participant violates these Terms or if MCAT Simplified reasonably believes the participant has engaged in fraudulent, abusive, deceptive, or unlawful activity. 

Termination of participation does not eliminate obligations or rights that accrued before termination, except where otherwise permitted by these Terms or applicable law. 

  1. Privacy 

Participation in the Referral Program may require MCAT Simplified to collect and process information relating to Referrers and Referred Customers, including referral codes, account information, transaction information, and payment information. 

Such information will be handled in accordance with MCAT Simplified's applicable Privacy Policy. 

Referrers should not provide MCAT Simplified with unnecessary personal information about people they refer. 

  1. No Guarantee of Course Results 

The Referral Program does not guarantee any particular educational, professional, financial, career, or other outcome from purchasing or completing a [Company Name] course. 

Referrers must not make claims about guaranteed results or outcomes that are not authorized or substantiated by MCAT Simplified. 

  1. Acceptance of Terms 

By participating in the Referral Program, using a referral code, or accepting a referral reward, you acknowledge that you have read, understood, and agreed to these Terms. 

If you do not agree to these Terms, you may not participate in the Referral Program.
